Social Security Disability Offset for Long-Term Disability

New Jersey Long-Term Disability Attorney

Often, long-term disability policies contain clauses concerning offsets for other sources of income that you may obtain while receiving benefits. This is an important part of your policy that you should be aware of and understand. Other income that can offset your long term disability benefits almost always includes Social Security Disability (SSD) payments. The offset allows your disability insurance provider to reduce its payments by the amount of your Social Security Disability payment.

Since approval for Social Security Disability benefits can take up to 2 years, you may owe all of your back benefits received from Social Security to your long term disability carrier. For example, if you begin receiving benefits from your LTD carrier on January 1, 2010, but then do not receive an award from Social Security until January 1, 2011, any past benefits that you receive from SSA that go back to January 1, 2010 will need to be refunded to your LTD carrier.

Sometimes you can end up owing your LTD carrier thousands of dollars and if you do not tender the money to them, your LTD payments will be terminated.  It is important that you sideline any funds received from SSA or any other income sources that can be offset by your policy.  If you were unaware of the offset, this can come as quite a shock. It may be financially impossible for you to repay such a large sum quickly.
