How does one go about applying for Social Security Disability benefits?

There are three ways to apply for benefits. One way is to go to your local Social Security Administration office and apply in person. The second way is to call them at their toll-free number (1-800-313-0213) to make an appointment to apply over the phone.  You can also file an application online at the Social Security website.   

What is definition of "disability" in getting benefits from Social Security?

The definition of disability is that you have a medical condition that is expected to go on for at least one year or a condition that will result in death. This is a strict federal definition that you must meet in order to be eligible for Social Security Disability benefits.

When is the best time to apply for Social Security Disability?

As soon as you become disabled according to the federal definition mentioned above. Because of how long it takes for an application to process, it is important to get started right away. An application may take from 5 to 24 months to complete. You will need to submit an application for Social Security Benefits and a Disability Report. In addition, you will be required to submit complete medical records from your doctor, therapist, hospital, clinic, as well as a list of the medications and their dosage levels that you are taking.  You will also have to provide extensive information about your work history.

My long-term disability insurance falls under ERISA. What does that mean?

Most long-term disability insurance obtained through your employer is governed by a federal law known as ERISA, which stands for the Employee Retirement Income Security Act. Under this law, certain mandated procedures must be followed in the disability claim process which will be outlined in your policy.
